Gibraltar is an overseas territory located at Europe’s southern tip. As a self-governing British Crown Dependency, the territory is dependent on UK only for its foreign affairs and external relations. As far as matters like taxation are concerned, it retains total independence. It is the only offshore region to become a full member of EU (European Union). Well-known as an important offshore financial centre across the world, Gibraltar was a natural selection for gaming jurisdiction.
The Government of Gibraltar introduced the Gambling Ordinance in 2005. The requirements for internet gambling in the region are defined in the document. In accordance with the Gambling Ordinance, different types of licenses that may be granted by Gibraltar licensing authority include a gaming operator’s license, a gaming machine license, a lottery promoter’s license, a pools promoter’s license, a betting intermediary’s license, a bookmaker’s license and a remote gambling license. Gibraltar is known as one of the most difficult places to acquire a gambling license. Only about 21 licensees have this honour. Although strict, it is one of the most desirable gaming jurisdictions because of reasonable tax rates.
Gibraltar Remote Gambling License Application
Entrepreneurs need to submit online gambling license applications to the Gibraltar Licensing Authority in accordance with the Gambling Ordinance 2005 guidelines. The application should provide details on the nature of proposed business activity, reasons for selecting the offshore territory as the centre for your gaming operations, background information on the company, benefits to the economy of Gibraltar and a general conclusion.
The online gambling license may be denied for a number of reasons. For instance, the presence of dissatisfactory characteristics in terms of reputation, integrity, character or honesty may be a reason for denial. Licenses offered by Gibraltar Licensing Authority are not transferable and can be used only by the holders. The license holders need to follow some strict guidelines. These includes offering a direct link to a site devoted to helping people suffering from gambling addiction and putting a system in place that enables problem players to self exclude themselves from gaming.
Gibraltar Gambling License Costs
Gibraltar licensing authority does not charge any start-up fee. License holders are required to pay a yearly fee of ₤2,000 to maintain the license. Betting exchange operations and fixed odds need to pay one percent of their total annual turnover as tax, with the upper limit of ₤425,000 per year. Online casinos are also taxed at the rate of one percent on their gross product. The upper limit for online casinos is once again ₤425,000.
Registration for taxation purposes is not necessary for non-resident organizations. This means that estate tax, VAT, wealth tax, gift tax or capital gains tax is not applicable to them. Until now, reasonable tax rate has been one of the main reasons for gambling establishments seeking a license from Gibraltar Licensing Authority, but starting 2011, the tax rates have been increased from substantially 1% to 10%. The need to conform to EU tax laws was stated as the reason for the increase. In spite of the increase, the absence of other taxes like VAT will allow Gibraltar gaming licensees to be competitive.
Additional Guidelines Set up through the Gibraltar Remote Gambling Licence
1. Advertising – target adult players only, truthful & accurate ads, requires online sites to police the websites linking to them to ensure no links/ads come in from sites catering to minors, advertising/targeting only countries where remote/internet gambling is explicitly legal,
2. Prizes – company must keep on hand any current prizes and estimated future prizes they have or plan to offer/advertise.
3. Privacy – Collect information to identify players and protect it.
4. Banking – Controlled by the company (the licensed bingo room operator). Controlling bank account for player funds must be established, registered, and approved by licensing agency. No verbiage on whether player funds or prize funds must remain separate from company’s operating account.
